The Night of Halloween
On the evening of November 1, 2015, Saifullah and the individual identified as Jane Doe in legal documents left the Yale Symphony Orchestra’s Halloween performance.
They decided to take a leisurely walk through the Grove Street Cemetery before returning to Trumbull College, where they both resided, just after 12:40 a.m. on November 1.
Once at Trumbull, Khan assisted Doe in opening her entryway, bid her farewell, and started to walk away. However, as he was about to enter his entryway, Doe called out his name and invited him to her dorm room.
Khan mentioned that he then accompanied Doe back to her room. According to Khan, Doe initiated undressing and engaged in oral activity with him in that setting.
However, she experienced discomfort and vomited when he preferred deeper involvement. Following this, Doe proceeded to shower, as Khan described.
He mentioned that he subsequently contacted his girlfriend, who testified during the trial, confirming their six-year relationship characterized as a “long-distance, open relationship.” Following a two-hour phone conversation with his girlfriend, Khan said he engaged in consensual, protected vaginal intercourse with Doe.
Case Against Saifullah
The woman with Saifullah on Halloween Night filed a r@pe case against him and accused him of taking advantage of her intoxication. During her testimony, Doe mentioned that in the early hours of November 1, while intoxicated, Khan engaged in vaginal intercourse with her.
She recounted having consumed two rum and cokes, two glasses of wine, and one shot of hard liquor earlier that night at a gathering at Shabtai, a Jewish society, before the YSO performance. Surveillance footage captured Doe and Khan walking past Sterling Memorial Library toward Trumbull College at 12:40 a.m. on November 1.
Doe, who testified on the trial’s first day the previous Monday, stated that her recollection of that night was fragmented. She recalled vomiting after entering her room and lying on her bed, fully dressed. At some point during the night, Doe recollected Khan being present beside her, getting on top of her, and engaging in penetration.
After a long battle that lasted 2 years, Khan was found not guilty of r@pe. A six-member jury gave the green signal to Khan and cleared him of sexual assault charges. As per sources, the jury took four hours to reach the decision. Saifullah was sobbing when he learned the court’s decision and thanked his family and friends.
Saifullah Demands 110 Million in Damages
Saifullah’s quest for justice persists; in the most recent turn of events, he lodged an ongoing legal suit against Yale last December. He asserts that YU violated his Title IX rights throughout the investigation, prompting his lawsuit seeking a significant $110 million in damages.
These damages are attributed to the hindrance of his degree completion, reputation harm, privacy breach, and emotional distress. Saifullah contends that Yale’s University-Wide Committee on Sexual Misconduct utilized fundamentally flawed approaches in its fact-finding process.
